Notice:  Beginning December 1, 2005 the law changed in NC that would allow for certain personal information to be redacted under guidelines set out in NCGS 132-1.10(f).
 
Some of the guidelines are as follows:
 
The request must be in writing, legibly signed by the requester or their power of attorney, delivered by mail, facsimile, electronic transmission, or delivered in person to the register specifying (1) the personal information to be redacted (2) the document containing the information re: book, page, instrument number, and (3)unique information that identifies the location within the document at which the information can be located. Only the identified personal information will be removed for the internet Website.

Notice: Fee Changes Effective Oct. 1,2011
 
Session Law 2011-296 (S 384) modifies the fees for recording instruments and simplifies their allocation to state accounts. For more information please see Land Records Bulletin 35
 
1. The fees for recording Instruments except deeds of trust and mortgages will be $26 for the first 15 pages and $4 each additional page. 
2. Deeds of trust and mortgages will be $56 for the first 15 pages and $4 each additional page.
3. There will no longer be an additional fee for verification (currently $2.00)
4. Additional subsequent instrument index reference is $10 each on assignments only.
 
 
Recording
 
The Recording Department of the Register of Deeds office is located at 216 North Second Street in Room 4. The office is open from 8:00 a.m. until 5:00 p.m.  The recording hours are 8:00 a.m. until 5:00 p.m.  All documents presented for recording must meet the following standards:
 
 
 
Vital Records
 
The Vital Records Department is located at 216 North Second Street in room 2 and 3. Their hours are 8:00 a.m. until 5:00 p.m., however Marriage licenses are not issued after 4:45 p.m.  Please see pages on Marriage Licenses, Birth and Death certificates for more information.  This office also files DD214's which are military discharges.

 Births & Deaths

 

 

Notice: Credit and Debit cards are accepted in all departments with the exception of the Recording department. 
 

You may now request a copy of a Birth or Death record over the phone and pay with your Visa or MasterCard by simply printing the NHC Copy of a Vital Records Authorization Form and filling out the requested information.

After printing application place Governmental issued ID, such as a drivers license on space provided on page 2 and photocopy form.  Fax both pages to 910-798-7757.  Once the order has been verified and processed you will be contacted to process payment.  Do not place any credit card information on authorization form, that information will be taken over the phone when order is processed. 

Your drivers license or state issued picture ID is required to receive a certified copy. You may print the application (link above) and bring it with you when applying. The fee for a Certified Copy of a Birth Certificate is currently $10.00 each. The fee for a Certified Copy of a Death Certificate is currently $10.00 each.

Certified copies of New Hanover County Birth and Death certificates may be obtained from the Vital Records Department, 216 North 2nd Street, Room 2 or at the Street level office located next to the 2nd Street Main entrance.

G.S.130A-26A(be)(1)  A person who commits any of the following acts shall be guilty of a Class 1 felony: Willfully and knowingly makes any false statement in an application for a certified copy of a vital record, or who willfully and knowingly supplies false information intending that the information be used in the obtaining of any copy of a vital record.

The Register of Deeds Office participates in the Statewide Birth Certificate Issuance Program, which enables local residents to obtain a copy of a certified birth certificate for individuals born anywhere in North Carolina from 1971 to the present.* The Register of Deeds is the legally authorized agent of the State Registrar to issue copies of certificates from the Statewide Birth Database, which is maintained by the State Vital Records Office in Raleigh. 

The cost for the service is $24 to research the certificate in the North Carolina state registry and includes one copy of the certificate.  Additional certificates from the same search will be $15 each. For residents born in New Hanover county the cost for a certificate remains $10 each.

*Exclusion: Birth certificates for individuals who have been adopted can only be issued by North Carolina Vital Records in Raleigh, NC. For more information, call  New Hanover County Vital Records at 910-798-4530

 

 Marriage Lic

 
 
Notice: Credit and Debit cards are accepted in all departments with the exception of the Recording department.
 
In the State of North Carolina, you may apply or use the marriage license in any county of the State. Marriage License Applications are taken from 8:00 am - 4:45 pm Monday - Friday.
 
Both the Bride and Groom must be present when the license is issued. In cases of extreme hardship when one applicant is UNABLE to appear (i.e. confinement in hospital, nursing home or prison), the individual who is unable to appear in person must submit a sworn and notarized Affidavit in Lieu Personal Appearance The affidavit, along with the required identification for both parties, must be presented by the individual appearing in person.
 
The fee for a Marriage License is $60.00. The fee for a Certified Copy of your Marriage License is $10.00.  You may request a copy of your Marriage License over the phone and pay with your Visa or MasterCard by printing the Vital Records Application and filling out the requested information.  After printing out the application place the Government issued ID, such as a drivers license, on the space provided on page 2 and photocopy the form and fax both pages to 910-798-7757.  Once order has been verified and processed you will be contacted to process payment.  Do not place any credit card information on authorization form, that information will be taken over the phone when order is processed.
 
The following must be presented from both the Bride and Groom before a license will be issued:
 
  • Applicants for Marriage in New Hanover County must provide Picture ID with date of birth.
  • Certified copies of birth certificates must be provided if either Bride or Groom is under the age of 21 (if birth certificate is from another country, couple must also provide a certified translation).
  • An acceptable proof of social security numbers or ITIN number  (Will accept W2 or statement from Social Security Administration).

*If you have been divorced in the last 60 days you must bring your divorce papers.*

The legal age for marriage in North Carolina is 18. Persons over 16 and under 18 can only be married with signed parental consent.  It is illegal for any person under 14 to marry in North Carolina.  Any person older than 14, but younger than 16 must obtain a Court Order through the Clerk of Court's Office at 910-772-6600 for additional information.
 
The marriage ceremony MUST be performed within 60 days after the license is issued.  If ceremony is NOT performed within 60 days following issuance of license, another license must be issued before a marriage can be performed. A Magistrate, Minister, or any other person authorized by their religious denomination, or federally recognized Indian Tribe, may perform a marriage ceremony.

Please note that if you do not come into the office within 10 days of completing the online marriage application the form will be deleted and you will be required to fill it out again in order to obtain a marriage license.

 

 Notary Public

For initial appointments, you are required to complete a Notary instruction class at your local community college, please contact them for further information.
 
For renewals you will not be notified when your commission is expiring, you should reapply approximately a month before your expiration date, for more information please refer to NC Secretary of State
 
When you have received your certification from the Notary Division of the Secretary of State's office, you must come to the Register of Deeds office within 45 days to take your oath and sign the Notary book. You must bring your drivers license and the $10.00 fee. If you do not take your oath within 45 days, you will have to apply for your commission again.
 
The Notary desk is located in Room 1 at 216 N. Second Street.
 
If you change your name or address during the life of your commission, you must notify the Notary division of the Secretary of State's office by certified or registered letter within 45 days. 
 

 UCC

 
The Uniform Commercial Code, N.C. General Statute, Chapter 25, is a collection of laws setting forth procedures by which claims may be secured against collateral used for a loan. The fees for filing these financing statements are as follows:

Effective 07/15/2003, only Financing Statements filed as a Fixture Filing will be recorded in the Register of Deeds Office.

 Assumed Names

Anyone conducting business in New Hanover County under a name other than the given name of the owner is required to give public notice by filing an Assumed Name with the Register of Deeds office. This document should be prepared by an attorney or the owner of the business. The Register of Deeds office does not furnish forms of this document. You may obtain forms by going to:
 
Before recording an Assumed Name, a search of the records should be performed to assure that name is not already in use. The Register of Deeds staff does not perform searches, but assist you in your search if requested.
