Can I put a fence in a platted or designated easement?

No, all easements must be kept clear of any and all obstructions such as trees, fences, structures, berms and ponds, in order to allow crews free access at all times.

When do I need a Land Disturbing Permit?

 a) When more than an acre is to be disturbed,

 b) when a permit has previously been issued on the property or project & additional land
     disturbance activities are planned,

 c) or when a parcel or project is less than 1 acre but is part of a larger project (i.e.
     common plan of development)

How much are Land Disturbing Permits?

Residential Subdivision

Review Fee: $200 (Paid at time of application, includes initial and 2nd review) 
Land Disturbance Fee: $150 per lot (Paid at the time of plat recordation)

All lots must be in the limits of disturbance and have erosion control measures.

Subsequent Reviews: $200 each (For each review after 2nd review)
Modifications: $200
Name Change: $200 
Transfer of Ownership: $200

Commercial Development

Review Fee: $200 (Paid at time of application, includes initial and 2nd review)  
Land Disturbance Fee: $400 per acre disturbed (Paid at the time of Certificate of Occupancy)

How long does it take to get a permit?

If a submittal is complete, a permit will be issued within the 30 day review period. If a project is not approved during the review it is returned for additional information. Fifteen (15) days after this additional information is returned the plans are reviewed. If the submittal is complete a permit is issued.

Does New Hanover issue Land Disturbing Permits in the City of Wilmington?

Yes, unless it is a City or County  Owned Project. New Hanover is not allowed to issue permits to entities who have powers of Eminent Domain ( the right to condemn property), or to projects that use local, state or federal funds. These projects are permitted thru the North Carolina Department of Environment and Natural Resources Land Quality Section at (910) 796-7215.

 What are the consequences if I decide not to get a Land Disturbing Permit?     

$5000 a day fines may be issued and possibly criminal penalties.
