Purposes
To regulate certain land-disturbing activity to control accelerated erosion and sedimentation in order to prevent the pollution of water and other damage to lakes, watercourses, and other public and private property by sedimentation.
What does the law require?
The law governs land disturbing activities except agriculture, forestry, mining and natural erosion. Erosion and sedimentation control are required regardless of the size of the disturbance. However, Land Disturbing Permits are only required on sites disturbing more than 1 acre. The law requires installation and maintenance of sufficient erosion control practices to retain sediment within the boundaries of the site.
Who enforces the law?
The Sedimentation Pollution Control Act provides authority to the State or authorized local agencies to inspect land disturbing activities and to prosecute violators. Citizens damaged by violations of the Act may also take action through the courts. New Hanover County has been authorized by the State to have its own Local Program. The Local Programs are monitored by the State and its regulations must meet or exceed the States minimum standards.
